No. A contractual statement alone cannot disapply CMR where its conditions of application are met; terms departing from the Convention are assessed under Article 41.

CMR's scope must first be established correctly; not every movement of goods is CMR carriage.
A simple explanation
CMR Article 1 defines the carriage to which the Convention applies. Article 41 provides for the invalidity of contractual terms contrary to the Convention, subject to the exceptions it specifies.
A contract sentence cannot cancel a mandatory convention.
