What determines whether Regulation 561/2006 or AETR applies to an international journey?

Primarily the entire route and the vehicle's country of registration, rather than the driver's nationality. EU rules apply within the EU and the associated EEA and Swiss territory; AETR applies to a journey outside that territory which falls within its scope.

A simple explanation
For a vehicle registered in an EU or AETR country, such an international AETR journey is assessed as a whole. Crossing a border alone does not justify changing activity-recording rules at your own discretion.
The journey determines the rules, not the passport.
